1. Agreement to Terms
By accessing or using IVF & Period Tracker ("the App"), you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, you may not use the App. The App is operated by IVF & Period Tracker ("we," "us," or "our").
2. Description of Service
IVF & Period Tracker is a health and wellness application that helps users track menstrual cycles, fertility windows, pregnancy milestones, and menopause symptoms. The App includes features such as cycle predictions, symptom logging, appointment tracking, educational resources, and an AI-powered companion named Luna.
3. Not Medical Advice
The App is intended for informational and educational purposes only. It does not provide medical advice, diagnosis, or treatment. The content provided through the App, including information from Luna AI, should not be used as a substitute for professional medical advice. Always consult a qualified healthcare provider with questions about your health, fertility, pregnancy, or any medical condition. Never disregard professional medical advice or delay seeking it because of information provided by this App.
4. Eligibility
You must be at least 18 years old to use this App. By using the App, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into these Terms.
5. Account Registration
To use certain features of the App, you must create an account. You agree to provide accurate, current, and complete information during registration and to keep your account information updated. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
6. Subscription and Billing
The App offers subscription plans with a 7-day free trial. By starting a trial, you authorize us to charge your payment method at the end of the trial period unless you cancel before it ends. Subscriptions automatically renew at the end of each billing cycle. You may cancel your subscription at any time through the Manage Subscription option in your Profile. Cancellation takes effect at the end of the current billing period. Refunds are handled in accordance with applicable law and our refund policy.
7. Acceptable Use
You agree not to misuse the App. This includes but is not limited to: attempting to access other users' accounts or data, using the App for any unlawful purpose, interfering with or disrupting the App's functionality, reverse engineering or attempting to extract the source code, or using automated means to access the App without our permission.
8. Intellectual Property
All content, features, and functionality of the App — including text, graphics, logos, icons, images, and software — are owned by IVF & Period Tracker and are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content without our express written permission.
9. User Content
You retain ownership of any data, notes, or content you create within the App. By using the App, you grant us a limited license to store, process, and display your content solely for the purpose of providing the service to you. We do not sell or share your personal health data with third parties for marketing purposes.
10. AI Features Disclaimer
The App includes an AI companion (Luna) that provides health-related information and guidance. AI-generated content may not always be accurate, complete, or up to date. AI responses are general in nature and do not account for your specific medical history or conditions. You should independently verify any information provided by the AI before making health decisions.
11. Limitation of Liability
To the maximum extent permitted by law, IVF & Period Tracker shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the App. Our total liability for any claims arising from these Terms shall not exceed the amount you paid us in the 12 months preceding the claim.
12. Termination
We reserve the right to suspend or terminate your account at any time if you violate these Terms. You may delete your account at any time by contacting us. Upon termination, your right to use the App ceases immediately, though certain provisions of these Terms will survive termination.
13. Changes to Terms
We may update these Terms from time to time. When we make changes, we will update the "Last updated" date at the top of this page. Continued use of the App after changes are posted constitutes your acceptance of the revised Terms.
14. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the courts located in Dallas County, Texas.
